Terms and Conditions

Welcome to the ALLPACK e-commerce website ("the Site" or "www.allpack.cr"), established under the laws of Costa Rica, whose main activity is to enable the display and online sale of products for purchase by consumers located in the Republic of Costa Rica ("Customers" or "Users").

www.allpack.cr is controlled and operated by ALLPACK ("ALLPACK"), a commercial company domiciled in Costa Rica. Users accessing the site from other countries do so at their own initiative and are responsible for complying with applicable local laws. Any claims related to the use of the site and its content are governed by Costa Rican laws. Users accessing www.allpack.cr from countries other than Costa Rica cannot make purchases on the site. By entering the Site, the User acknowledges having read and understood these Terms and Conditions of Use ("Terms and Conditions") and therefore agrees to comply with its content, privacy policy, legal notices, and all disclaimers contained therein. These Terms and Conditions are subject to change without prior notice. As of the date of modification of these Terms and Conditions, all transactions between www.allpack.cr and the User will be governed by the modified document.

01. User Registration on the Site. During the registration process on the Site, the following personal information will be collected: Contact information, including name, ID number, phone number and email. At the time of payment, credit card number and billing and/or shipping information may be requested; Recipient's ID number if it is a person other than the User; Information related to personal interests and product preferences.

02. User Capacity. The services of www.allpack.cr are available only to those persons with legal capacity to contract as provided by current Costa Rican legislation. If the User lacks such legal capacity, they may not conduct transactions on the Site.

03. User Verification. Impediment of Use. By accessing this site, the User agrees to provide correct and truthful personal information for the effective delivery of purchased products. www.allpack.cr will review the request submitted by the User and reserves the right to verify the data provided by each User. If an inconsistency is found in the User's information at the time of registration or if they fail to notify any changes, www.allpack.cr may proceed with order cancellation and immediate termination of the User's account. If the User has any pending balance, it must be paid in full before proceeding with account closure.

04. User Responsibility. The User agrees to promptly notify the corresponding financial or cooperative sector entity of the loss or theft of their credit card and other instruments provided by them to conduct transactions, such as debit cards, personal passwords, among others, in order to disable such instruments. The User is prohibited from transmitting or sending from this Site any illegal, threatening, libelous, defamatory, obscene, scandalous, pornographic and/or any other material that could give rise to civil or criminal liability under the Law. Likewise, the User agrees not to use any device, software, among others, to obstruct the proper functioning of the Site and its contents and the activities carried out on it.

05. Products and/or Services. www.allpack.cr offers its Users mainly products such as bags, grease-resistant sheets, cup holders, pizza boxes and other paper and cardboard packaging products offered on our site. 5.1 Product Display. www.allpack.cr displays product images as clearly and accurately as possible. However, the color display of the products will depend on the monitor used to access the Site. 5.2. Product Availability. www.allpack.cr is responsible for updating the site and constantly reviewing the products displayed on the Site. However, www.allpack.cr may modify and discontinue products at any time without incurring any liability to Site Users. www.allpack.cr varies stock from one branch to another, likewise product stock varies from one moment to another. If a purchase is made and there is no stock, the money will be refunded through the banking system. The refund process is carried out with authorization from the customer and through the banking system, the business management is done immediately, the total banking process may take 15 to 22 days. The consumer's consent is manifested in the Site's purchase steps by accepting each of them and is perfected with the final purchase confirmation after reviewing the order summary. Before final purchase confirmation, the Customer may cancel the purchase at any time. www.allpack.cr will issue a receipt acknowledgment to the email registered by the Customer upon registration, with information on delivery time, exact price, including taxes, shipping costs and the payment method used.

06. Payment Conditions. The price to be paid for each item purchased will be the current price on the Site at the time the order is placed. Before www.allpack.cr accepts any purchase request, the Customer must choose the payment terms and conditions according to the payment methods established on the Site. www.allpack.cr provides Users with a secure connection system for transactions conducted on the Site. However, in no case will it be responsible for failures in communications from banking or credit entities, nor for damages caused to the Customer due to an action or omission by such entities. Once the Site verifies payment, it may proceed to accept the purchase request. In any case, even if payment has been verified, www.allpack.cr may deny acceptance of a purchase request or accept it partially, in which case it will only be obliged to refund the Customer, without any interest or yield, the amount paid for the unaccepted purchase request or the percentage corresponding to the unapproved part of a partially accepted purchase request.

07. Payment Information. Among the alternatives contemplated on the Site for payment of selected products, www.allpack.cr provides Users with a link to the respective payment gateways authorized by the Site. In such cases, the handling of personal information will be the exclusive responsibility of the payment gateway. Users must accept the Terms and Conditions of Use of the payment gateway before conducting their transactions. Additionally, payments are received via bank transfers; in this case the User must notify through available channels when payment has been made. After verification, the product will be shipped.

08. Promotional Coupons. Unlike credit or debit cards, promotional coupons used in digital coupons are debited when the order is placed. Digital coupons can be automatically redeemed for the total amount of a purchase and must be used in a single transaction, taking into account the specified expiration date. The coupon expiration date will not be modified.

09. Shipping Charges and Taxes. The Customer must pay the shipping cost at the time of purchase. The shipping cost may vary according to the weight and volume of the requested product. All taxes caused by the purchase will be settled from the moment the Customer makes their purchase request on the Site, and therefore they may know the exact amount to be paid to www.allpack.cr, which will include all the aforementioned concepts. Amounts corresponding to product deliveries will only be assumed by www.allpack.cr or reimbursed to THE CUSTOMER when www.allpack.cr has made an error when shipping the products, or when it is proven that the product damage was due to irregularities in product handling during transport. Otherwise, the customer must assume the shipping costs associated with changes or returns.

10. Product Delivery. www.allpack.cr will deliver products only within the Republic of Costa Rica through the courier service of Correos de Costa Rica and therefore may refuse to accept a purchase request when the delivery address registered by the Customer is not within the geographic areas enabled by Correos de Costa Rica for this purpose. Products purchased by the Customer will be delivered to the address stated by the customer when placing their purchase request or at a Correos de Costa Rica branch, depending on the delivery area and whether the postal service does not deliver directly to the address. Deliveries will be made within a period of 3 to 8 business days depending on the destination, counted from the date the Site accepts the corresponding purchase request, and provided that the payment terms and conditions have been determined in advance and no causes beyond the will of www.allpack.cr arise that could delay delivery. It is understood that any adult present at the delivery address will be duly authorized by the Customer to receive their order. Therefore, www.allpack.cr is exonerated from any responsibility for the delivery made, as long as it is made to the address registered on the Site. If no one receives the order at the indicated address, the courier company will attempt to contact the recipient by phone; if contact cannot be made, the User must contact www.allpack.cr through available channels to coordinate a second delivery and associated charges. www.allpack.cr also delivers products at points of sale, in which case the User when making the purchase must select the "Pick Up In Store" option and specify the point of sale where they wish to pick up the product.

11. Exchange Policies. Conditions to meet to make an exchange: Original invoice in good condition. Reprinting of invoices is not permitted at any of our stores. The product must be returned within a maximum period of 30 calendar days from the date of receipt. All items must be returned in the same condition as delivered (must have labels and original packaging). The product must not have physical damage or modifications of any kind indicating use, misuse, handling or natural wear. Returns or exchanges of items will only be accepted for manufacturing defects attributable to our company. www.allpack.cr reserves the right to reject exchanges of products that are not in the same condition as delivered or that are returned after the established period. Exchanges for manufacturing defects: If you requested to pick up your order at one of our points of sale, you can process the exchange at the location where the product was delivered. The exchange will be made as long as all the aforementioned conditions are met and will be effective as follows: -The same product in a different size cannot be exchanged due to product safety guarantee issues. Unless it is due to a product defect. No cash refunds will be made. In case of manufacturing defects, the return can be made through Correos de Costa Rica, the customer must assume the shipping cost. Once the product is received and defects are detected, replacement will proceed and all shipping costs incurred for the claim will be covered by www.allpack.cr. The customer must deliver the product properly packaged to prevent damage during transport. The original purchase invoice must be attached. In this case, you must contact our service agents through available channels; they will assist you in coordinating the product return. Manufacturing defects refer to bags or packaging stuck inside, or bags or packaging without adhesive on sides or bottoms, or replacement due to incorrect product shipment by our fault. Product replacement will be made only when the defective quantity exceeds 10% of the shipped product. If the number of defects attributable to our fault is less, a credit note will be issued for the corresponding amount to be applied to future purchases.

12. Refund Policies. www.allpack.cr will proceed with the refund of the invested amount to the Customer when the banking entity charges the customer more for the transaction made (duplicate payments). The customer must contact www.allpack.cr and request a transaction review to verify the existence of duplicate payments or those not corresponding to any requested order. In this case, THE CUSTOMER must provide the necessary data to carry out the respective banking procedure for the corresponding refund of amounts. The delivery time and appearance in the customer's account statement will vary depending on the card-issuing bank.

13. Warranty Policy. The warranty period will be thirty (30) days from the date of product purchase and issuance of the corresponding invoice. The warranty for products purchased on the site is limited solely and exclusively to factory damages and defects. However, this warranty will be void if www.allpack.cr proves misuse of the product by the User or third parties unrelated to www.allpack.cr, or if the products show physical damage or alterations, including but not limited to wear, scratches, scrapes, breaks, impacts, ink application, modifications, among others. In case the purchased product has any of the aforementioned conditions, www.allpack.cr will not make any type of money refund or merchandise exchange.

14. Intellectual Property Rights. All computer, graphic, advertising, photographic, multimedia, audiovisual and/or design material, as well as all contents, texts and databases (hereinafter "the Contents"), made available to Users on the Site are the exclusive property of ALLPACK, or of third parties who have authorized their use and/or exploitation. Likewise, the use of some third-party content is expressly authorized by Law and is protected by copyright, trademark and all applicable national and international regulations.

15. Personal Data Protection. By accepting the legal terms and conditions, the User indicates that they know and authorize ALLPACK, its subsidiaries and affiliates in advance, expressly and informedly, so that their personal data may be stored and used to achieve efficient communication during the present procedure or activity and authorize under the same terms, that such information may be processed in accordance with the provisions of Costa Rican Law and its Regulatory Decrees, in order to receive information about their products, services, offers, promotions, alliances, studies, contests, contents. Likewise, the User has been informed about the personal data protection policy available on the Site, which includes the consultation and claim procedures that allow the effective exercise of Users' rights to access, know, consult, rectify, update, and delete data, and equally the User may submit any request related to personal data through the email: legal@allpack.cr

16. Liability Waiver. As long as the User has not timely notified the existence of the violation of their personal information, or when the User has not proceeded to notify the corresponding financial or cooperative entities of the loss, misuse, theft or robbery of the instruments granted by them to conduct transactions, or when there is misuse of their registration data, www.allpack.cr assumes no responsibility for such actions.

17. Computer Security. Cookies are small data files that websites like www.allpack.cr or emails save in your browser and optionally on your hard drive. Cookies allow us to "remember" information about your preferences and session, and allow the User to navigate within the Site areas without re-entering their data. This makes it possible to create a more personalized and comfortable shopping experience. www.allpack.cr uses a third party to install cookies on the User's computer to collect non-personal and non-identifiable information. Although cookies contain a unique User number, they do not collect or store any personally identifiable information. Although the User can configure their Internet browser not to accept cookies, they are necessary to view, create an account, or make purchases through the www.allpack.cr website.

18. Applicable Law and Jurisdiction. These Terms and Conditions will be governed and interpreted in accordance with the laws of the Republic of Costa Rica. Any dispute arising from this document will be submitted to applicable laws and competent judges in accordance with Costa Rican legislation.

19. Independence of Provisions. If one or more of the provisions contained in these Terms and Conditions are considered null, illegal or ineffective in any aspect, the validity, legality and enforceability or effectiveness of the remaining provisions of this document will not be affected or annulled by such circumstance.
